Lord Leverson is a retired Appeal Court judge.
He was asked to look at reducing costs and delays in the court system. He was TOLD he had to look at trials without juries.
Lord Leverson suggested a new “Crown Court Bench Division” within the existing system. A judge and two magistrates would sit on this bench. The new bench would hear cases that would go to the crown court where the estimate is that a likely sentence is less than 3 years. Even if the estimate turned out to be incorrect the new bench would have the power to sentence up to the maximum sentence allowed for the offence.
Lord Leverson also recommended judge-only trials for certain serious complex trials, like fraud.
