The government BIG LIE!
The only argument the government has for making this radical change (that was not in the Labour manifesto) is the backlog. They claim the change will make trials go faster. The Institute for Government said, “judge-only trials in England and Wales will save less than 2% of timein crown court.”. The Bar Council estimates that this will reduce the delay for a trial by one week for a two year wait. Everyone agrees the numbers Sir Brian Leverson uses are very uncertain.
Victims weaponised
Making the lie worse the government have weaponised victims of sexual assault claiming rape victims need this change. Charlote Nichols the Labour MP for Warrington North in the House of Commons said she is a rape victim and does not back these changes, not all victims agree. The Bar Council has suggested a separate path for sexual offences with specially trained judges and barristers and courts set aside just to deal with sexual offences. Terrorist cases have a separate path and they have less than half the delays that other criminal cases have.
This ISN’T the Canadian system
The government says that they have modelled these changes on what happens in Canada. In Canada you have a CHOICE between a judge only trial and a jury. This is a vital safeguard that the government has not even spoken about and is planning to OMIT from the British system. Public interest cases need juries, protest cases need juries, ethnic minorities need juries (as David Lammy’s own report highlighted!).
